How to manage conflict minerals

ITM Semiconductor is committed to meeting social responsibilities by actively participating in non-use of conflict minerals.

Definition of conflict minerals

Conflict Minerals are defined that refers to four minerals (tin, tantalum, tungsten, gold) mined from the Democratic Republic of Congo (DRC) and its adjoining countries. The covered countries are 10 : including Democratic Republic of Congo, South Sudan, Rwanda, Burundi, Uganda, Republic of Congo, Zambia, Angola, Tanzania, Central African Republic. These areas are confirmed to be those in which militants, such as rebels and government forces, control the mining and distribution of minerals, thereby securing funds and continuing the conflict. This causes not only human injury but also human rights problems such as human rights violation of local residents and exploitation of labor force to extract minerals, and also causes social problems such as environmental pollution. As the "Dodd-Frank Wall Street Reform and Consumer Protection Act", which includes the conflict mineral regulation clause in July 2010, passes through the US Congress, the grounds for legally sanctioning the use of conflict minerals has been created. From 2014 to May 31, in every year until May 31, we must report to the Securities and Exchange Commission (SEC) whether or not to use conflict minerals. We will require companies listed on the US stock market to report the use of conflict minerals and disclose information. As a result, domestic companies that deliver products to US listed companies as well as listed companies have been affected by these regulations.

Things that ITM Semiconductor do.

  • 1. ITM Semiconductor (referred to as "the Company") complies with and follows the 3TG(conflict minerals) Regulation.
  • 2. The company DO NOT use the conflict minerals that are provided from high risk area (the covered 10 countries).
    - If it's a conflict mineral in a high-risk area (10 countries), we can use a conflict minerals that's validated with RMI.
  • 3. The company DO NOT use conflicting minerals that are used to fund human rights violations or military conflicts..
  • 4. The company DO NOT use conflicting minerals that are the beneficiaries of money laundering, bribery offenses, or funding them.
  • 5. If it must be used unavoidably, The company will identify the situation and reduce the portion of conflict minerals.
  • 6. The company analyze supplier chain of conflict minerals.
  • 7. The company builds strategy to optimize supply chain of conflict minerals and manage efficiently.
  • 8. The company establishes a plan to respond to the conflict mineral survey.
  • 9. Suppliers shall communicate sufficiently with the content of the conflict minerals that we require, complete and submit the required documents, and suspend the contract if the default occurs consecutively.
  • 10. The company pledge to carry out due diligence in accordance with OECD guidelines.
  • 11. We promise to be supplied only from smelters by independently verified.
